CHOX TERMS OF SERVICE
1. ACCEPTANCE OF TERMS
This document outlines Audatex (UK) Limited's terms of service (TOS). This document may be updated periodically without notification and it is recommended that you should re-visit this page and review this document regularly.
2. DESCRIPTION OF SERVICE
Audatex provides users with access to CHOX, hereafter known as the 'Service'. Any changes to the 'Service' will be in accordance with the TOS detailed below.
In order to use the 'Service', you must have access to computer equipment, capable of accessing the Internet (World Wide Web) and pay any service/and or telephony fees associated with such access. Please be aware that each user will have access to specific content on the 'Service', associated to their role or business.
3. REGISTRATION
In acceptance of the use of the 'Service', you agree to provide true, accurate and complete information about yourself, as already made available to your employer.
Should Audatex have any reason to believe that any information given is not wholly true or false then Audatex reserves the right to suspend or terminate access rights of any person using the 'Service'. This also covers any future versions of the 'Service'.
4. Audatex PRIVACY POLICY
User information and passwords are stored in accordance with our Privacy Policy.
5. PASSWORD AND SECURITY
Audatex will provide you, the user, with a password and user name once you have been authorised to use our 'Service'. You are responsible for maintaining the confidentiality of your password and account and are responsible for all activity on your account whilst it remains logged on to the 'Service'.
6. USERS CONDUCT
Whilst using the 'Service', you may have the ability to upload information onto the system.
You agree to not use the 'Service' to:
a. Upload, any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
b. Use another person's log on credentials to use the 'Service' or impersonate another user in any way;
c. Upload any content for which you do not have authority to view or use;
d. Wilfully or knowingly upload any files that contain viruses. This also relates to any files that are designed to damage, destroy or limit the functionality of the 'Service';
e. Unlawfully collect data from the system that you are not privileged to.
You acknowledge that Audatex may send your password/user name to a predefined email address on demand in order to recover lost/forgotten credentials. You acknowledge that Audatex may make this information known to a superior should there be reasonable grounds to do so.
7. TERMINATION OF CONTRACT AND SERVING NOTICE
You acknowledge that your user credentials will be blocked and access denied should Audatex be notified of your employment being terminated. This may also apply if you are serving out your notice period. Audatex will not make checks on your contract status, and it is the responsibility of the company to make Audatex aware of any changes or personnel.
8. RESALE OF SERVICE
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the 'Service', use of the 'Service', or access to the 'Service'.
9. AMMENDMENT TO SERVICE
Audatex reserves the right to amend, modify or update the 'Service' with or without notice.
10. DISCLAIMER AND LIMITATION OF LIABILITY
Audatex makes no representations or warranties of any kind, express or implied, as to the operation of the 'Service', or the information, content or materials included in the 'Service'. Your use of the 'Service' is at your sole risk.
To the fullest extent allowed by law, Audatex disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for purpose. Audatex will not be liable for any damages arising from the use of the 'Service', including direct, indirect, incidental and consequential damages.
11. USE OF COOKIES
We use the following cookie types on this site:
1. Session cookies: these are used to maintain information about your current login session and are essential to the correct running of the application.
2. Persistent cookies: these are used to maintain display preferences, such as grid column ordering and sizing, between different login sessions.
No other cookies are used (e.g. we do not add cookies for statistical or advertising purposes).
12. GDPR Disclaimer
By using the Audatex product you understand and acknowledge that you will not enter any Personal Data, the term being as defined under Regulation (EU) 2016/679 (or any superseding legislation in the UK from time to time) ("GDPR"), including but not limited to the types and categories of Personal Data listed, defined, or referenced to in Articles 8 - 10 of the GDPR (collectively "High Risk Personal Data"), into any of the free text fields, nor will you incorporate any Personal Data or High Risk Personal Data into any of the images or attachments that you might upload into the Audatex system from time to time.
The entering of Personal Data into free text fields or the incorporation of Personal Data into images or attachments would result in the breach of your contract and/or agreement with us and/or the breach of relevant data protection laws and subject you to legal liability. We process your personal data in accordance with our privacy policy.
